The Condo Free service is managed and granted by the company ACCA software SpA, later related to as ACCA.
These following Terms of Use, regulate access and use of services by the user of Condo Free ("Services" or "Condo Free"), and any information, text, document, photographs or any other material uploaded or downloaded present in such services ("contained"). A user is the person, the registered holder of the user account and licensee, as defined in these Terms of Use. Access and use of such Services will be subject to your acceptance and compliance with these Terms of Use. By accessing or using the services, you agree to comply with these conditions.
The user is responsible for password custody used to access the services and any activity or action that requires the use of this password. ACCA recommends the use of complex passwords (consisting in a combination of uppercase and lowercase letters, numbers and symbols) with your account. ACCA cannot take and will assume no liability for loss or damage caused by disregard of these recommendations. You assume, furthermore, full responsibility for any abuse and/or violation of these Terms by third parties that may operate with your assigned user-ID and password. You shall immediately notify ACCA, at the privacy@condofree.net email address, of any unauthorized use of your personal user-ID and/or password or any other breach of security that you may become aware of. It is forbidden for the user to resell the right to access the services or any other commercial use, without the written consent of ACCA.
By accessing or using these services, the user cannot perform any of the following: (i) access, tamper with, or use restricted areas of services, ACCA and Condo Free computer systems or technical delivery systems of Condo Free providers. (ii) check, scan or test the vulnerability of any system or network or breach or circumvent any of the security or authentication measures. (iii) access or search for access or search the Services by any means (automated or otherwise) other than by published interfaces that are currently available and provided by Condo Free. (iv) falsify the headers of any TCP/IP packet or part of the header information in any e-mail or post or otherwise use the services to send other kinds of content, alter the source or send deceptive or false information. (v) interfere with or disrupt the access of any user, host or network, introducing viruses, overloading the system or by using techniques of flooding, spamming, aimed to block, stop or damage service continuity.
The user also agrees not to use the service for illegal purposes or for the transmission or exchange of any unlawful, harassing, libellous or defamatory, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene or that infringes or may infringe the rights of intellectual or industrial property or other third party services, which causes annoyance, disturbance, violence, child abuse, exploitation or harm, in any way etc., or for the dissemination of chain letters, or for the distribution of bulk e-mails (spamming).
The services may include advertisements, also targeted to the Content or information regarding the available services or the website or queries made throughout the Services or any other information. The types and amount of advertising produced by ACCA services may of course be subject to change.
Condo Free and its contents, is physically stored in hosting mode on server. The use of the services and content is to be considered as time-limited and distribution methods will be from time to time expressed by the commercial and sales communications. The user recognizes and acknowledges that all technological achievements at the base of the services and facilities are owned by ACCA.
ACCA may decide to terminate your access to services and content at any time and for reasons that can't be questioned by the user.
Services and content are not available to the customer as they are physically stored on a machine (server) that is not owned by the user and to which ACCA grants access to a limited extent in terms of space and time.
Content may not always be available in the case of service malfunctions or may not be available in the case of termination of services, because all content is stored on a remote machine not owned by the end user (all content is in fact stored on a server run by ACCA) and, in the event of termination of services, cannot be managed or recovered.
The user acknowledges and agrees that the services and content are provided by means of an Internet connection. The user undertakes whatever measures necessary to procure the required technology (being either both hardware and/or software) for such access.
The content posted on Condo Free is protected by current legislation regarding the protection of copyright.
ACCA expressly excludes any warranty in relation to the information and content provided on the website that is provided "As is" without any guarantee of continuity, completeness and accuracy. In no event ACCA and its member companies will be liable for damages, direct or indirect, that may result from the use of the services or contents of the site.
ACCA does not accept any liability for any direct or indirect damage, which may be generated by the use of the contents or malfunctioning or suspension of services, from failure or suspension of access to services or content that they manage and that is accessible via the Internet from the ACCA server.
Services and content accessible via the Internet may be subject to any kind of failure and may even generate a faulty data recovery, mismanagement or loss of data.
ACCA will not be liable for any direct or indirect damages including loss of data or failure to achieve commercial benefits and opportunities resulting from the delay, malfunction or non-use of content and services, and directly attributable to the failure by Force Majeure of the ACCA server or not depending on the company, such as technical failures and electrical blackouts, telephone and computer faults, strikes, acts of vandalism and terrorism, common disasters and natural disasters.
Data is processed in accordance with the requirements of the Privacy Code.
The Italian version of this agreement is legally binding and prevails in case of any inconsistency between the Italian version and its translation.
The conditions described in this document will be effective as from their acceptance by the user and will remain valid for the entire duration of delivery of all content and services supplied by ACCA. The user expressly authorizes ACCA to send any subsequent amendments to the conditions that constitute the current contract terms.
All disputes which may arise between ACCA and the end user will take place within the territory jurisdiction where the Headquarters offices of ACCA software SpA are registered.
